Judge tosses Crunchberry lawsuit
Woman thought they were real fruit

SACRAMENTO, California - A woman lost her case against the makers of Cap'n Crunch with Crunchberries. Janine Sugawara claimed she was deceived by the cereal’s marketing and packaging. She claimed she had been eating the cereal for four years under the assumption that the Crunchberries were in fact real berries.

A California judge dismissed the complaint stating there's no such fruit as a Crunchberry and that the box clearly depicts them as round, crunchy, brightly-colored cereal balls.

U.S. District Judge Morrison England Jr. of Sacramento found that that a reasonable consumer would not have been deceived by the packaging . The cereal box makes no claim to be particularly nutritious, nor does it contain any images of actual fruit, he said.

The judge in the case also noted that the same plaintiff's firm, Hewell Law Firm in San Diego, filed a similar claim against the packaging of Froot Loops cereal , which was rejected by another California district court.

Some people are just plain STUPID!

See that is just people now a days trying to win bogus cases. Kind of like the woman that won one million dollars because her dumb ass spilled coffee on herself. Did she think she ordered an iced coffee...NO!! That lady was just stupid and found a small loop hole and that is all these guys are doing. I still don't think se should of won that case. Looking for something they could sue for that has no relevance.

DBG is right there are people out there where this is all they do so they don't have to work and have a real job. They just look for loopholes to sue companies and the lawyers eat it up because they get almost 50% of the winnings. Everyone wants the easy money and no one wants to work for it anymore. Look at most of the kids these days they think that they should get anything they want. I've seen some of them turn jobs down because $9/hr wasn't enough and mind you they had no prior anything experience and fresh out of high school. Just go back and look at our friends from HS and see where they ended up. Some of mine ended up being bums with a couple finally growing up coming to their senses and cleaning their acts up. These reality shows don't help either for those idiots that think they can just fall right into the money and fame. Just watch the American Idol auditions, it is full of those fools. That's the only reason I watch that show and the only part too, good for a few laughs.
